terms and conditions
Welcome to Couture Botanical and new look forward to creating your wedding flowers. It is our aim that your special event be as beautiful and memorable as possible. We will work closely with you to ensure everything is exactly as you wish. We have found that it is helpful for all concerned to have a clear understanding or our policies.
· Prices and specific details of the agreed upon floral arrangements are included in the “wedding/event estimate”. This includes but is not limited to vase hire, bouquet holders, ribbons, wrist corsage hardware and delivery.
· Any rental items not returned within three (3) days of the wedding/event date will be billed to the wedding/event party at the replacement value.
- Any missing or breakages of rental items during the wedding/event date or pack down by the venue will be billed to the wedding/event party at the replacement value.
· Whilst we encourage you to provide images as concepts and inspiration please note that it is not our intention to recreate other vendors artistic work. We will solely use these as a guide towards creating something unique for you and your bridal party.
· Due to the intricacies and unpredictability of Mother Nature, supply and demand and potential limits on imports some of your favourite blooms may not be in season for your wedding. We do our best to source and gather the best flowers available but cannot guarantee the availability of either blooms or foliage until it arrives in our studio a few days before your wedding day. Where required Couture Botanical reserve the right to make bloom and foliage substitutions to ensure quality and aesthetic of our designs. These may include fresh, silk or dried blooms substitutions.
FORCE MAJEURE
In the event of a ‘Force Majeure’ including extreme weather events and Covid 19 lockdowns and restrictions which causes Couture Botanical’s services to be suspended or terminated when certain circumstances beyond our control arise, making performance inadvisable, commercially impractical, illegal or impossible we will, in consultation with you, negotiate a suitable postponement date.
If Couture Botanical cannot perform or believes it may not be able to perform this Agreement in whole or in part due to a fire, natural disaster, act of war or terrorism (domestic or foreign), epidemic or pandemic (including COVID-19), action of any governmental authority, national or regional emergency, other casualty, act of God, or other cause beyond the control of the parties or due to illness or injury, whether or not foreseeable (“Force Majeure Event”), then Couture Botanical will give notice to the Client as soon as reasonably practicable after Couture Botanical determines that a Force Majeure Event will or may prevent Couture Botanical from performing under this Agreement. Couture Botanical shall have no obligation to perform under this Agreement and no liability for delays or failures to perform due to a Force Majeure Event, but Couture Botanical may, in our discretion, work with the Client to find an alternative date for the Event that is suitable to both Client and Couture Botanical. In the case of a Force Majeure Event, Couture Botanical shall have no additional liability to Client with respect to this Agreement beyond that described in this Section and below.
In the case of a Force Majeure Event that impacts Couture Botanical individually, but does not otherwise impact the Event, including, but not limited to, illness or injury to Couture Botanical, Couture Botanical shall employ their freelance florist for the Event. The Client understands that Couture Botanical works to maintain a safe work environment, including but not limited to, complying with applicable governmental laws, directives, orders, and regulations (each a “Governmental Order”). Client further understands and agrees that Couture Botanical shall not be required to perform under this Agreement if the Event is held in violation of a Governmental Order or Couture Botanical’s participation in the Event would violate a Governmental Order. Client also understands and agrees that Couture Botanical is not obligated to continue to perform under this Agreement if Couture Botanical’s personal safety or well-being has been or will be comprised or threatened at the Event, including, but not limited to, as a result of the condition of the venue for the Event, or the conduct of an attendee of the Event.
WEATHER
Wet weather plans must be in effect four (4) hours before the ceremony. Failure to do so and therefore resulting in the need for last minute relocation of structures and installations will incur an hourly fee of $250 and payable in full. The client understands that arbour floral and outdoor arrangements may be limited or prevented from installation by the weather and venue. Therefore will not hold the florist responsible for problems that arise from these outside forces.
Due to extreme weather conditions the client accepts that all fresh blooms and foliage may not look as fresh as they did at the commencement of your wedding day due to the effects of extreme heat, windy or cold weather. COUTURE BOTANICAL takes all care to ensure that your blooms will be at their best for the entirety of your event.
Outdoor installations and arches are subject to weather conditions. They will not be installed in the case of extreme heat, wind or rain. Couture Botanical will determine if it's unsuitable to complete installation three (3) hours before the ceremony commences and notify the client's allocated contact person. Considerations taken into account are: safety of staff and guests, working conditions and maintaining product quality. The Client must have an alternative plan for outdoor ceremonies. Couture Botanical will make every effort to find another suitable location to set up installation.
THIRD PARTY SUPPLIERS
Any arbours, structures or hardware we deem unfit or unsafe to work with, will not be used at our discretion. We recommend contacting us for a list or preferred suppliers. We will always aim to make alternative arrangements but safety comes first.
